Please read these terms & conditions of use carefully. By purchasing the FIT CHICKS Academy® Holistic Nutrition Weight Loss Coach Program, you agree to abide by these terms & conditions, which will constitute our agreement and program release.

DISCLAIMER

You agree you are 18 years old or older. You alone are responsible for your actions and results in life, fitness, health and business.

When addressing fitness, nutrition or wellness in any of our programs, websites, videos, newsletters or other content, they are for educational purposes only and do not replace, or override the advice your own medical health representative(s).

We do not claim that anything taught in our programs, available on our websites or contained in our videos, newsletters, social media, emails, books or other content, will guarantee fitness, nutrition, wellness or lifestyle treatments or cures.

We make no representations, warranties or guarantees that you will achieve any results from our ideas or content presented in our programs, available on our websites or contained in our videos, newsletters, books, social media, emails, and we offer no professional, legal, medical, psychological or financial advice in connection with same.

You agree you have reviewed your province, state or country laws and regulations when it comes to coaching in fitness, nutrition or wellness prior to purchasing this program. We do not make any guarantees this program will provide you with employment of any kind including starting your own business.

As a graduate from Holistic Nutrition Weight Loss Coach Program it is your responsibility to ensure any clients, guests, customers or anyone you share information with are aware that it is for their own educational purposes only and it is not medical advice. You agree it is also your responsibility to to get your own legal advice within your area to confirm use of any waiver forms, intake forms or any forms that are required for coaching as well as insurance within your province, state or country laws and regulations

SOME COUNTRIES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY IN CONTRACTS WITH CONSUMERS AND AS A RESULT SOME OF THE TERMS OF THIS SECTION MAY NOT APPLY TO YOU.

This agreement includes this legally binding liability release, waiver, discharge and covenant not to sue (the “Release”), made by you, to (i) LAJQ Chick Enterprises Inc. (ii) to the representatives, employees, agents and contractors of LAJQ Chick Enterprises Inc., and (iii) to the shareholders, officers and directors of LAJQ Chick Enterprises Inc., and their respective heirs, legal representatives, successors and assigns (collectively the “Releasees”).

You fully recognize that there are dangers and risks to which you may be exposed by participating in an educational programs or classes at FIT CHICKS® Academy., and/or on its websites including Fitchicks.ca, Fitchicks.com and FitchicksAcademy.com, which may involve working with body weight exercises, exercise equipment and culinary equipment and tools that may be dangerous. With full understanding of the risks involved and despite this Release, you agree that you are voluntarily choosing to participate in a program or classes operated by LAJQ Chick Enterprises Inc. and you are willing to participate in the activities associated with those endeavors.

In consideration of and in return for the services, access to content and/or use of facilities, and other assistance provided to you in these activities, you agree that you release the Releasees from any and all liability, claims, and actions that may arise from injury or harm to you, including from your death or from damage to your property in connection with these activities.

You understand that this Release covers liability claims and actions caused entirely or in part by any acts or failures to act by the Releasees, including but not limited to negligence, mistake, or failure to supervise.

You further agree to abide by all the rules and regulations promulgated LAJQ Chick Enterprises Inc. while performing these activities.

You recognize that this Release means you are giving up, among other things, rights to sue the Releasees for injuries, damages, or losses you may incur while participating in these activities. You agree that you also understand that this release binds your heirs, executors, administrators, and assigns, as well as yourself.

Limited License Agreement
You are purchasing one individual (no sharing) participation in the Holistic Nutrition Weight Loss Coach Program or one copy of another single advanced training video program enrolment (each, and collectively, “Product”), granting you access during your program dates. We make no guarantee about unlimited ongoing access and reserve the right to add or remove content at any time.

Duplicating, sharing, or uploading Product (or any part of a Product) or any published materials from our websites to sharing sites is considered stealing, and we reserve the right to take any and all legal action against such theft as we see fit to the full extent of the law.

The Product, including all related course material and any content, including from our websites, is protected by copyright, trademark, and other intellectual property laws, and as between you and us, is owned by LAJQ Chick Enterprises Inc. or its suppliers or licensors. The Product, related course material and content, including from our websites, is licensed to you solely for your individual, personal, noncommercial use.

You may not use the Product or the materials available in the Product, related course material or the content, including from our websites, in a manner that constitutes an infringement of our rights or that has not been authorized by us.

More specifically, unless explicitly authorized in this agreement or by the owner of the materials, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the Product, related course material or the content, including from our websites.

You may, however, from time to time, download and/or print one copy of individual pages of the FitChickAcademy.com website for your individual personal, noncommercial use, provided that you keep intact all copyright and other proprietary notices.

If you violate any of the foregoing license terms, your license will immediately terminate and you will cease all use of, and destroy any copies of, the licensed materials.
In addition, certain Products contain additional use and rights terms, which will be applicable to the product in which they are contained.

You agree that you will notify us of any feedback or suggestions relating to the Products, service and content, and related materials; and you hereby grant to LAJQ Chick Enterprises Inc. a nonexclusive, irrevocable, worldwide, perpetual, unlimited, assignable, sub-licenseable, fully paid up and royalty-free right to copy, prepare derivative works of, improve, distribute, publish, remove, retain, add, process, analyze, use and commercialize, in any way now known or in the future discovered, any information you provide, directly or indirectly to us, including all feedback or suggestions.
You promise and warrant to only provide us information and content that you have the right to give us, and you will indemnify us in respect of any claims and/or actions if this is not true.
All rights not expressly granted under this agreement are reserved by us and our licensors and suppliers.

HOLISTIC NUTRITION WEIGHT LOSS COACH CERTIFICATION PROGRAM REFUND POLICY

The deposit for this program is non-refundable but can be used as a credit toward future programs in the event you need to cancel your registration at anytime for first time enrollees only.

To receive the refund, after participating in the program for 14 days following the start date and you show us that you’ve kept up with all the work including classes, quizzes, assignments and practical hours (you have to show us proof!), and for some crazy reason DO you not feel like you are growing personally and professionally, then we will be happy to return the investment.

But, you DO have to do the work.

The Holistic Nutrition Weight Loss program is for women who are committed to learning and growing in the nutrition, weight loss, and wellness fields, who want to spread the healthy love and get more clients, and NOT for people who just want to collect a piece paper to say they have it.

And we will be strict on this last point – you absolutely must do the work and submit within 14 days* to be eligible for a refund. In the event that you decide your purchase was not the right decision, within 14 days of enrollment, contact our support team at hwle@fitchicks.ca and let us know you’d like a refund by the 14th day at 11:59 EST. You must include your coursework with your request for a refund. If you request a refund and do not include your coursework by the 14th day, you will not be granted a refund. There’s so much transformation waiting for you on the other side of this program, and since our main goal is for you to succeed, we aren’t afraid to give you some tough FIT CHICKS love when it comes to holding you accountable.

*Refunds will only be issued if all complete work is submitted by day 14 following program start date to fne@fitchicks.ca. If proof of work is not submitted by Day 14 following your registration date, no refunds will be granted. No exceptions or extensions will be provided. No refunds will be issued after 14 days of your registration date including the deposit for the program or if proof of work has not been submitted up to standard.

The work that you need to submit with your request for a refund includes ALL of the following items:

Quizzes 1 -2

All payments for this program are 100% non-refundable after the 14 days of purchase in the event you need to cancel your registration. We will NOT provide refunds more than 14 days following your registration date. After day 14, all payments are non-refundable and you are responsible for full payment of the fees for the program regardless if you complete the program. No refunds will be issued.

Please note: If you opted for a payment plan and you do not request a refund within 14 days, with the required coursework at the time of your refund request, you are required by law to complete the remaining payments of your payment plan.

PROGRAM TRANSFER POLICY

We understand that you may need to change programs due to various reasons. Our transfer policy allows first-time enrollees to transfer to another program. The following guidelines must be adhered to for a successful transfer application:

Timing: The transfer request must be made within the first 30 days of the program start date. Any request received after the deadline will not be considered.

Eligibility: The transfer option is only available for first-time enrollees.

Fees: The fees for the new program may differ from the previous one, and it is the student’s responsibility to pay the difference. Additionally, there will be a $97 administrative fee for all transfers.

Course Schedule: Transferring students will be advised on the new course schedule based on their new program of study.

Limitations: Students can only transfer to another program once. Any subsequent transfer requests will not be considered.

At the end of the transfer process, the student must comply with the same academic policies, rules, and regulations that apply to their new program of study. We hope that this policy has been helpful in outlining the steps required to apply for a transfer to another program within the first 30 days of the program start date.

PAYMENT PLANS, DEFERRALS, & RESTARTS

If you default on your payment plan, your access to the members site and Facebook group will be revoked until your payment is successfully processed. There will be a $20 non-sufficient funds fee for any declined or defaulted payments.

You agree that all program materials are to be submitted within 5 months of your registration date for the Holistic Nutrition Weight Loss Coach Program in order to be eligible to graduate. Certificates will not be issued if there is balance on your account. You do have the option to pay off your balance and receive your certificate earlier.

In the case you can not meet the deadline or need to pause the course, you can request a deferral or a restart for the Holistic Nutrition Weight Loss Coach Program at a $497 restart fee + applicable taxes. Access to all program materials will be revoked and regranted upon payment and registration for the restart. The option to restart is only valid for a maximum of 1 year after the deadline of the course and you can only restart twice. After 1 year and/or your second restart you will forfeit all work to date and be required to re-register for the full program at the current rate.

You also have the option to elect for the Holistic Nutrition Weight Loss Education Program. Please note this is not a certification but acknowledgement you have completed the theory portion of the program.

FIT CHICKS UNIVERSITY

You agree to maintain your certification and complete 4 online continuing education credits through FIT CHICKS University each calendar year of your certification in order to stay current. These online classes will be packed full of awesome education to help you master your craft and continue to grow and learn in this awesome field*

*FC University reminders will be sent prior to certification due date. An additional course fee of $89 + tax applies to complete.

If you miss your recertification date and are within one month of your expiration date we will allow you to submit all of your requirements within that month. A late fee of $20 (+ applicable taxes) as well as the $89 (+applicable tax) recertification fee will be required.
If you have missed your recertification by more than one (1) month and less than one (1) year, you are able to reinstate your certification by completing a written exam and maintain your original certification date. A reinstatement fee of $99 (+ applicable tax) as well as the $89 (+applicable tax) FIT CHICKS University recertification fee will be required.
If you have been expired for more than one (1) year you will be required to complete both the theory and practical exams again, your certification date will be adjusted to reflect the new date. A reinstatement fee of $297 (+ applicable tax) as well as the $89 (+applicable tax) FIT CHICKS University recertification fee will be required.

ASSIGNMENT POLICY

Outside of the online classes, the home study and practice outside of class is extensive.

There is a lot of information to cover, absorb and put into home practice and we want to support you every step of the way! As much as we want you to feel super confident in the fierce skills you are about to bring to the world, we also need to ensure that you have earned your certification and are ready to receive your diploma.

That said, please see the following guidelines for all assignments and practical placements:

Please upload your assignments to the members site in a zip folder if there is more than one file.
Any written assignments are to include:
Cover page with name, date and assignment titles
Font Times New Roman, size 12 -14, double spaced and page numbers
All headings must be bolded
Cite references: In some of the assignments, you may need to reference someone else’s work, stats, or statements. We also want you to learn this skill to ensure you don’t plagiarize someone else’s work and it is not as hard as you think. For reference guide, please see and include references in the footnotes: http://www.libraries.psu.edu/content/dam/psul/up/lls/documents/MLAQuickCitationGuide.pdf . You can also easily cite at the online citation making site http://www.easybib.com/ )
Written assignments will be marked and returned with feedback within 15 business days of receipt. In the event an assignment is not completed to standard, we will return with feedback to rework and resubmit to ensure the concepts are understood.
Students are required to complete all tests and assignments with a min grade of 75% to pass the course
Practical coaching hours or assignments can commence after the final section of the program is complete. This is to ensure you are practicing what you have learned.
All students have up to 5 months to complete all quizzes, assignments and coaching. This will not be extended. Should you not be able to complete the program, there is a one time deferral fee where you will be able to start again with a restart fee of $497 + Applicable taxes. Certificates will not be issued until all materials are submitted and marked.

Please make sure to review assignments in advance and plan any questions accordingly.

ASSIGNMENT SUBMISSION POLICY

Assignments are to be completed and uploaded on the member’s site under the corresponding module

Please ensure that you include your name in the file name of the assignment so we know who it belongs to, ie Assignment 3 – YOUR NAME.

Marked assignments will be sent back to you within 8 business days.

QUIZ POLICY

There will be quizzes after each module (For quiz schedule, please see the “Calendar and Modules Overview”)

You can access the quizzes on the Members Site under each corresponding Module.

Please note the quizzes are approx. 10 – 20 questions based on the material covered during the module. It is an open book and you will have 3 times to redo in event you score under 75%.

The Final Exam is 100 questions long and requires a passing score of 80% and must be completed in one sitting. You may attempt this exam up to 3 times. This exam covers everything from modules 1-8 and will be in multiple choice format. You can complete this as soon as you finish module 8, before your practical exam or after.

PRACTICAL EXAM POLICIES

The final component of the course is a practical exam in the form of a live zoom call where you will be coaching the examiner. The practical exam can only be completed once all other course materials have been submitted and marked.

In order to successfully pass the exam students must obtain a min grade of 75%.

Your Practical Exam CANNOT be booked until all assignments have been marked and returned to you.

The time booked for the practical exam is reserved just for you. The time will go into your calendar in your selected time zone (Example if you are PST, it will automatically change to your local time zone when booking if you indicate your time zone is PST) It is your responsibility to know the time difference in your area.

Late / No Show / Canceled within 24 hrs: If you are unable to make it please cancel at least 24 hours before. If you are more than 5 minutes to your exam, do not show up for your exam or cancel / reschedule within 24 hours prior to your exam time, there will be a re-booking fee of $50 + applicable taxes that is automatically charged to your credit card on file. By booking the practical exam, you agree to the above.

Technology – You are responsible to test all audio and video prior to starting the exam so make sure to log on 5 min early and do this. In this event your tech does not work and we have to stop the exam after 5 minutes of your scheduled start time, you will be required to re-book with a fee of $50 + applicable taxes that is automatically charged to your credit card on file. By booking the practical exam, you agree to the above.

As per FIT CHICKS Academy® policy, if your Practical Exam does not meet the standards you will have the opportunity to redo the exam. The fee is $97 + applicable taxes. You will have up to 3 months to re-book.

FINAL DEADLINES

Final deadline to submit Assignment 3 & 8 in order to book your practical exam prior to the deadline

Final due date for all material submission for the Holistic Nutrition Weight Loss Coach Program

= 5 MONTHS FROM PROGRAM START DATE.

CERTIFICATES

A Certificate of completion is issued digitally via email once per week and hard copies will be mailed once per month, subject to the following conditions:

Full Payment: A certificate will only be issued if there is no outstanding balance on the student’s account. If there is an outstanding balance, the certificate will not be issued until the balance is paid in full. However, the student has the option to pay off the balance and receive the certificate earlier.

Course Requirements: The certificate will be issued to students who have successfully completed the program by the due date. The due date for completion is 6 months after the start date. If all course requirements are met before the due date, the student will be eligible to receive the certificate prior to the due date.

Extension Option: Should the student not be able to complete the program by the original due date, they have the option to purchase a 6 month extension for the program for the fee of $497+ tax. All of the student’s work completed to date will be transferred, and they will have 5 months from the restart date to complete the program.

By enrolling in the program, the student acknowledges and agrees to the above terms and conditions regarding the issuance of the certificate of completion.

Please note it is our strict policy that all communication internal and external be respectful towards all members of our community and that any foul language, slander or comments made to create a negative experience for anyone in our community will not be tolerated

We want you to succeed and are here to help support you along the way. Program support includes 8 weekly live coaching calls during the 8 weeks class is in session, access to the private Facebook community, and written coaching support via email.
